By creating an account or using TradieTax AI ("Service", "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not create an account or use the Service.
These Terms constitute a legally binding agreement between you ("User", "you", "your") and TradieTax AI ("we", "us", "our"). These Terms should be read together with our Privacy Policy.
TradieTax AI is a software tool that provides the following features to help you manage your business finances:
Tax Agent Services Act 2009: The features above are software tools and calculators. They do not constitute tax agent services, BAS agent services, or tax advice as defined under the Tax Agent Services Act 2009 (Cth). TradieTax AI is not registered with the Tax Practitioners Board (TPB). For regulated tax agent services you must engage a registered Tax Agent or BAS Agent.
TradieTax AI uses artificial intelligence (OpenAI API) to extract data from your uploaded documents. You acknowledge and agree that:

All software, design, branding, and content of TradieTax AI are owned by us or our licensors and are protected by Australian and international intellectual property laws. You retain full ownership of all data, documents and records you upload to the Service. By uploading data, you grant us a limited, non-exclusive licence to process and store it solely for the purpose of delivering the Service to you. We will not use your data for any other purpose.
To the maximum extent permitted by law, including the Australian Consumer Law (ACL):
Australian Consumer Law: Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited. If the Australian Consumer Law applies to you, our liability for a failure to comply with a consumer guarantee is limited (at our election) to re-supplying the service or refunding the price paid for the affected service.
We aim to maintain high availability but do not guarantee uninterrupted or error-free access. We may suspend or modify the Service for maintenance, security, legal compliance or operational reasons. We will endeavour to provide advance notice where practicable. We are not liable for any loss resulting from service unavailability.
We are not liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, government action, power failures, internet outages, third-party service failures (including Supabase, OpenAI, Stripe or Vercel), cyberattacks or pandemic.
You may delete your account at any time from Profile settings. Deletion is permanent and irreversible — export your data before deleting. We may suspend or terminate your account if you breach these Terms, without prior notice. Upon termination, your right to use the Service ceases immediately. Your data will be deleted within 30 days of account deletion.
Our collection, use and disclosure of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you agree to our Privacy Policy.
Any commercial electronic messages we send (including subscription notifications) comply with the Spam Act 2003 (Cth). Each such message will clearly identify us as the sender and include a functional unsubscribe mechanism. You may opt out of non-essential communications at any time by contacting support@tradietax.ai. Transactional messages (account security, subscription changes) cannot be unsubscribed from.
We may modify these Terms at any time. We will notify you by email at least 14 days before material changes take effect. The updated Terms will be posted at tradietax-ai.vercel.app/terms. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales. Before commencing legal proceedings, you agree to first contact us at legal@tradietax.ai and allow 30 days to attempt resolution in good faith.
If any provision of these Terms is found to be invalid, illegal or unenforceable, it will be severed from the Terms. The remaining provisions will continue in full force and effect.
